Wrist Slap
We learn today that the sleazeball functionary of Wells Fargo who squatted in Bernie Madoff’s $12m mansion has been fired. I want to know where are the criminal charges? Isn’t this at least breaking and entering? Criminal trespass? Fraud? If this isn’t against the law, I want to throw a BBQ there this weekend. Mister D.A. where are you?

It may well not be criminal trespass or technically against the law since she had been given access to the property as “manager” of foreclosures by the ostensible owner. This is probably about the same legal area as if a house-sitter threw a party at your house against the rules you’d agreed on. I’m not sure if Wells Fargo could (or would) press charges against her on some grounds, but the DA probably can’t because Wells was apparently the “owner” and they gave her a degree of control (at least the implicit terms of which she obviously violated.) So it really does probably add up to a violation within the company’s guidelines, rules and tacit understandings of appropriate behavior by an employee entrusted with her particular responsibilities. So firing is likely the max. I’m not sure that’s exactly a wrist slap, given what her job expectations as low-level exec have become and the notoriety she’s garnered. She’ll be lucky in the near term if Starbucks will hire her. Now if she’d been at the level where she could have driven one of the biggest banks into total collapse, she’d probably be in line for a multi-billion dollar bailout and a large personal bonus before the year’s out.

She has a bachelor’s degree from Emory and an MBA from USC. Perhaps she should have gotten a JD degree as well.

Opinion L.A. – So let me offer this admittedly lame defense for Wells not accepting offers on the Malibu Colony property or even allowing prospective buyers to visit the home….
Maybe some of it has validity, but I wouldn’t defend her.
